1. Right to Apply

Pursuant to Article 11 of Law No. 6698 on the Protection of Personal Data (KVKK), natural persons whose personal data is processed may apply to the data controller in order to exercise their rights specified in the law.

Requests relating to the personal data processing activities carried out by İmacyu Teknoloji San. ve Tic. Ltd. Şti. in the capacity of data controller are assessed within the scope of the relevant legislation.

2. Subject Matter of Applications

Data subjects:

  • May learn whether their personal data is being processed.
  • May request information about their personal data that has been processed.
  • May learn the purpose of the processing and whether the data is being used in accordance with that purpose.
  • May learn the third parties to whom the data is transferred.
  • May request the rectification of incomplete or inaccurate data.
  • May request the erasure or destruction of the data within the scope of the statutory conditions.
  • May request that the rectification and erasure operations be notified to the relevant third parties.
  • May object to any result arising to their detriment as a consequence of exclusively automated processing.
  • May claim compensation for their damage by reason of unlawful data processing.

3. Methods of Application

Applications may be made by methods that comply with the Communiqué on the Principles and Procedures for Applications to the Data Controller.

Written application

Applications may be sent in writing to İmacyu's official address for service.

Electronic application

In accordance with the conditions specified in the relevant legislation, an application may be made by means of:

  • Registered electronic mail (KEP),
  • Secure electronic signature,
  • Mobile signature,
  • The e-mail address previously notified by the applicant to the data controller and registered in the system

as set out above.

As regards the validity of electronic applications, the application and identity verification conditions specified in the relevant Communiqué apply.

4. Information Required in the Application

Applications must contain the following information:

  1. First name and surname.
  2. Republic of Türkiye identity number; for foreign nationals, nationality, passport number or, if any, identity number.
  3. Residential or workplace address for service.
  4. If any, e-mail address, telephone number and fax number for notification.
  5. Subject matter of the request.
  6. Signature, in written applications.

To the extent necessary, information and documents supporting the request may be attached to the application.

In order that the application can be assessed securely and accurately, İmacyu may carry out identity verification procedures in accordance with the relevant legislation.

5. Assessment of the Application

Applications are assessed and concluded, according to the nature of the request, as soon as possible and within 30 days at the latest.

Applications are, as a rule, free of charge. In the cases prescribed by the relevant legislation, a fee in accordance with the established tariff may be charged.

6. Applications Relating to Customer Systems

Applications relating to personal data held in the ERP, CRM or other software systems of a customer to which İmacyu provides services in the capacity of data processor may need to be assessed by the relevant data controller.

In such applications, İmacyu provides the necessary cooperation in line with the relevant legislation and contractual obligations.

7. Complaint to the Personal Data Protection Board

If the application is rejected, the response given is found to be insufficient or no response is given within the time limit, the data subject may lodge a complaint with the Personal Data Protection Board subject to the conditions and within the time limits specified in Article 14 of the KVKK.
